People of the State of New York v. ExxonMobil Corp.

In a podcast available on the Federalist Society website, Andrew Grossman discusses the post trial decision in People of the State of New York v. ExxonMobil Corp., a case brought under New York’s Martin Act, an anti-fraud statute, alleging that ExxonMobil misled its investors about how the company accounted for climate-change risks.

On November 7, 2019, the last day of a nearly three week trial, the New York Attorney General dropped two of the four counts against ExxonMobil. And on December 10, Justice Barry Ostranger ruled for ExxonMobil on the remaining two counts, noting in his conclusion that “The testimony of the expert witnesses called by the Office of the Attorney General was eviscerated on cross-examination and by ExxonMobil’s expert witnesses.”
