Memoranda of Understanding in China-US Commercial Transactions

At the China Law Blog, Dan Harris has an interesting piece on the use of memoranda of understanding (MOU) in commercial transactions between companies in the U.S. and China.  In particular, Harris focuses on the enforceability of such documents, which may differ based on the respective laws of the U.S. and the People's Republic, as well as the specific provisions contained therein. Some of the discussion is relevant to any MOU, not just those that cross transnational lines.
